Terms and Conditions for Construction Training Centre Courses

  • THESE TERMS
    • What these terms cover. These terms and conditions ("Terms") apply to the construction training courses ("Courses") delivered by Weston College through its construction training centre at Locking Head Drove, Weston-super-Mare, North Somerset, BS24 7NA ("Construction Training Centre").
    • Why you should read them. Please read these Terms carefully. These Terms tell you who we are, how we will provide the Courses, the cost implications of bookings, what to do if there is a problem and other important information. By reserving a place on one of the Courses you enter into a binding contract with Weston College and agree to be bound by these Terms.
    • Are you a business customer or a consumer? In some areas you will have different rights depending on whether you are a business or consumer. You are a consumer if:
      • You are an individual.
      • You are taking the Courses wholly or mainly for your personal use (not for use in connection with your trade, business, craft or profession).
    • If you are a business this is our entire agreement. If you are a business these Terms constitute the entire agreement between us. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of us which is not in these Terms and that you shall have no claim for innocent or negligent misrepresentation or misstatement based on any statement in this contract.
  • INFORMATION ABOUT US AND HOW TO CONTACT US
    • Who we are. We are Weston College, a college of higher education at Knightstone Campus, Knightstone Road, Weston Super Mare, Somerset, BS23 2AL ("Weston College").
    • How to contact us. You can contact us by telephoning 01934 411 411 or by writing to us at enquiries@weston.ac.uk or Weston College, Knightstone Campus, Weston College, Knightstone Road, Weston-super-Mare, BS23 2AL.
    • How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us.
    • "Writing". "Writing" or "written" in these Terms includes emails.
  • OUR CONTRACT WITH YOU
    • How we will accept your booking. Our acceptance of your booking will take place when we email you confirming the booking, at which point a contract will come into existence.
    • If we cannot accept your booking. If we are unable to accept your booking, we will inform you of this and will not charge you for the Course. This might be because of unexpected limits on our resources which we could not reasonably plan for or because we have identified an error in the price or description of the Course.
    • Confirmation of your place. Your contract with Weston College, and any applicable cooling off period, will commence immediately upon confirmation.
  • COURSES
    • Classroom courses. The Construction Training Centre delivers classroom based Courses which tend to be relatively short in duration ("Classroom Courses"). These can be found at https://www.construction-training-centre.co.uk/product-category/classroom/.
    • Practical courses. The Construction Training Centre also delivers practical Courses outside of the classroom which tend to be longer in duration ("Practical Courses"). Weston College will assist you in identifying the appropriate Practical Course. These can be found at https://www.construction-training-centre.co.uk/product-category/practical/.
    • Making sure your requests are accurate. You are responsible for ensuring that the information you give us is correct. We will not be responsible for not delivering an appropriate Course if it has been selected based on the information you have given us.
  • COURSE FEES AND PAYMENT
    • Online payment terms and conditions. Please note our online payment terms and conditions can be found at https://www.weston.ac.uk/terms-and-conditions.
    • Classroom Courses. Fees for Classroom Courses are set out at https://www.construction-training-centre.co.uk/classroom-courses/. Fees will be due immediately and payment is made directly online upon booking.
    • Practical Courses. Fees for Practical Courses will vary depending on the Courses identified by you and Weston College. Once appropriate Practical Courses have been identified, Weston College will issue a quotation and a booking form for you to complete.
    • In relation to Practical Courses:
      • New customers. The balance of the fees will be due no later than 7 calendar days before the commencement date of the Practical Course.
  • Our right of set-off if you are a business. If you are a business you must pay all amounts due to us under these Terms in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).
  • Late payment. If you do not make any payment to us by the due date and we deem it reasonable in the circumstances we may charge interest to you on the overdue amount at the rate of 4% a year above the base lending rate of the Bank of England from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment.
  • Course fees include first attempt examination or assessment fees only. Any reassessments will be charged for separately.
  • Review of fees. Weston College may amend and review fees, taking into account UK inflation rates and other costs.
  • COURSE CHANGES
    • Right to make changes. Weston College will use its reasonable endeavours to deliver your Course in accordance with the description set out on Weston College's website and/ or given to you. Weston College may however make changes to your Course which it considers necessary including, but not limited to:
      • in order to reflect changes to the subject area;
      • in order to reflect changes required by an accredited body or changes in relevant laws and regulatory requirements; or
      • if your experience would or would likely be improved.
    • Changes made by Weston College may include, without limitation, changes to the Course structure, content, location, dates and times.
    • Substantial changes. Weston College will notify you in writing where making a change to your Course would, in Weston College's reasonable opinion, constitute a materially different service to that which you agreed when booking your place on your Course. In such circumstances, you will be given the opportunity to (i) transfer to a different Course or (ii) withdraw from your Course, in each case by giving Weston College written notice within 14 calendar days of being notified of such substantial change. Where you have chosen to withdraw from your Course, Weston College will refund in full any instalments of your Course fees already paid. Weston College will have no further liability beyond this.
  • DEFERRAL OR TRANSFERS
    • No deferral right. There is no automatic right to defer the date of a booked Course. Weston College will consider requested deferrals on a case by case basis. Deferrals, if permitted in writing at Weston College's discretion, will generally be permitted once only.
    • No transfer right. There is no automatic right to transfer a booked Course to another. Weston College will consider requested transfers on a case by case basis. Transfers, if permitted in writing at Weston College's discretion, will generally be permitted once only.
    • Fee liability. Upon an approved deferral or transfer, you will be liable to pay for any increase in Course fees. Please note that you will not be reimbursed for any decrease.
    • Upon an approved deferral or transfer, your deposit (should you have been required to pay one) will be retained and carried over.
  • YOUR RIGHTS TO CANCEL
    • Right to change your mind if you are a consumer. If you are a consumer then you have a legal right to change your mind within 14 calendar days and receive a refund. Please note that your right as a consumer to change your mind does not apply once the Course has been completed, even if the cancellation period is still running.
    • Ending the contract because of something we have done or are going to do. If you are cancelling a Course for a reason set out at (a) to (d) below the contract will end immediately and we will refund you in full any fees for Courses which have not yet been provided and you may also be entitled to compensation. The reasons are:
      • we have told you about an upcoming material change to the booked Course or these Terms which you do not agree to (see clause 6.3);
      • we have told you about an error in the price or description of the booked Course and you do not wish to proceed;
      • there is a risk that delivery of the Course may be significantly delayed because of events outside of our control; or
      • you have a legal right to terminate because of something we have done wrong.
    • Bespoke courses. Where Courses are made to your bespoke specifications, please note that you will not be able to cancel your contract with us if any material steps have been taken towards this bespoke Course. Material steps shall include, but are not limited to, placing an order for materials or resource. You also do not have the right to terminate because you change your mind in such circumstances.
  • HOW TO END THE CONTRACT WITH US
    • Tell us you want to end the contract. Please let us know if you wish to end the contract by calling customer services on 01275 465555 or emailing us at info@somax.eu.com. Please provide your name, home address, details of the booking and, where available, your phone number and email address.
    • How we will refund you. If you are entitled to a refund under these Terms we will refund you the fee you paid by the method you used for payment.
    • Deductions from refunds. If you are a consumer and exercising your right to change your mind, we may deduct from any refund an amount for the delivery of the Course already supplied, ending with the time when you told us you had changed your mind. The amount will be in proportion to what has been delivered, in comparison with the full Course fee.
  • OUR RIGHTS TO SUSPEND OR CANCEL
    • We may suspend or cancel if you break these Terms. Weston College may refuse, withdraw an offer, suspend or cancel your accepted booking if:
      • you do not make payments when due and you still do not make payment within 14 calendar days of us reminding you to;
      • you have outstanding debt for another Weston College course;
      • you have not supplied requested documentation or you have not met eligibility criteria for your Course;
      • you fail to take your place at the Course or you fail to attend on a regular basis;
      • your place becomes unviable or practically impossible for Weston College. This includes, but is not limited to, if there are not enough confirmed places or too many confirmed places on your Course; or
      • you are found to have committed gross misconduct or a serious criminal offence.
    • Refunds. If Weston College is unable to run your Course or cancels your place for the reasons listed in clause 10.1 above, we will refund to you any money paid in advance for the Course. If you break the contract we reserve the right to deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.
  • IF THERE IS A PROBLEM WITH THE COURSE
    • How to tell us about problems. If you have any questions or complaints about the Course, please contact us. You can telephone our customer service team at 01275 465555 or write to us at info@somax.eu.com or to Construction Training Centre, Locking Head Drove, Weston-super-Mare, North Somerset, BS24 7NA.
    • Fixing the problem. If you are a consumer and the Course has not been delivered with reasonable care and skill, you can ask to repeat it or get some money back.
  • OUR RESPONSIBILITY FOR LOSS OR DAMAGE
    • We do not exclude or limit our liability where it would be unlawful. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to our delivery of the Courses.
    • If you are a consumer. If you are a consumer and we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract was made, we both knew it might happen, for example, if we discussed it during booking.
    • If you are a business. If you are a business, subject to clause 12.1:
      • we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us;
      • our total liability to you for all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total sums paid by you for the Courses.
    • HOW WE MAY USE YOUR PERSONAL INFORMATION
      • How we will use your personal information. We will only process your personal data in accordance with the Data Protection Act 2018 and Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (commonly known as the General Data Protection Regulation (the "GDPR")).     • OTHER IMPORTANT TERMS
      • Health and Safety. We pride ourselves on providing a safe work environment and take steps to ensure the highest standards of health and safety are achieved. To help us ensure that these standards are met, you agree to abide by all health and safety instructions and measures we put in place.       • By booking a place on a Course you accept and agree to be bound by and comply with all Weston College policies including, but not limited to, those published from time to time on our website; [our health and safety rulebooks]; all rules and regulations relating to your Course including in relation to attendance, disciplinary and exam rules, appeals, and eligibility requirements.
      • Intellectual Property Rights. All and any intellectual property rights including without limitation copyright in all and any written materials supplied by West College to you shall at all times remain the property of Weston College.
      • We are not responsible for delays outside our control. If delivery of the Course or any aspect of the Course is delayed by an event outside of our control then we will contact you as soon as possible and take steps to minimise the effect. Provided we do this we will not be liable for delays, but if there is a risk of substantial delay you may contact us to end the contract and we will refund you payments made in advance for Courses not provided.
      • We may transfer this agreement. We may transfer our rights and obligations under these Terms to another organisation. We will contact you if we plan to do this. If you are unhappy with the transfer you may contact us to end the contract within 14 calendar days of us telling you about it and we will refund you payments made in advance for Courses not provided.
      • Consent to transfer your rights. You may only transfer your rights or your obligations under these Terms to another person if we agree to this in writing.
      • Nobody else has rights. No other person shall have any rights to enforce this contract.
      • If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
      • Even if we delay enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this contract that will not mean that you do not have to do those things and it will not prevent us taking steps against you later.
      • Which laws apply and where you may bring legal proceedings if you are a business.
        If you are a business, any dispute or claim arising out of or in connection with a contract between us or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction.
      • Which laws apply and where you may bring legal proceedings if you are a consumer. These Terms are governed by English law and you can bring legal proceedings in respect of this contract in English courts. If you live in Scotland you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or the English courts.
      • Alternative dispute resolution if you are a consumer. Alternative dispute resolution is a process where an independent body considers a dispute and seeks to resolve it, without you having to go to court. If you are a consumer and are not happy with how we have handled any complaint, you may want to contact an alternative dispute resolution provider.

Weston College Construction Training Centre CGI

The SOMAX Construction Training Centre is Weston College’s purpose-built training facility.

Located off junction 21 of the M5, the centre provides training at the point of need for businesses and their employees. It’s also been designed to tackle skills shortages in the construction industry.

Each aspect of the centre has been developed to deliver training in a specific industry area – plant operations, street and groundworks, scaffolding, forklifting, and logistics.

As well as the ‘practical’ training areas, the centre boasts everything required of a modern, state-of-the-art educational facility. This includes a canteen, changing facilities, an IT suite, test and exam rooms, meeting spaces and a range of classrooms.
